移动课堂|会展中的知识产权保护与企业海外维权实践

2025年5月6日,国知院30余国际师生移动课堂访问虹桥国际中央商务区和国家会展中心,先后参访了虹桥国际中央法务区、虹桥海外发展服务中心、虹桥国际人才服务中心、进博会进博文化展示中心及国际会议中心,并开展以“会展中的知识产权保护与企业海外维权实践”为主题的移动课堂。国际学生感受了中国的大门更高水平、更宽领域、更深层次的"全方位开放”,深切感受到与中国同行就是与机遇同行,相信中国就是相信明天,投资中国就是投资未来。学院党委书记覃文忠、党委副书记林旻、2024级国际班班主任李昕带队。

在国家会展中心参与“会展中的知识产权保护”为主题的专题座谈。国家会展中心(上海)总裁宁风强调,知识产权保护在进博会等国际盛会中的重要作用,并表达了与我院加强合作的深切期望。交流环节中,进博会食品及农产品展区负责人褚天文结合真实案例,深入解析海外展商知识产权保护中的侵权判定、维权流程等议题。郭国中主任就知识产权法律服务如何融合技术、经济、社会和文化背景进行深入探讨,并从跨国视角理解与比较知识产权保护的不同模式。现场气氛热烈非凡,留学生们纷纷踊跃提问,进行深入互动交流。

国家会展中心(上海)是全球规模领先的会展综合体,也是中国国际进口博览会的举办地。中国国际进口博览会是世界上第一个以进口为主题的国家级展会,已成功举办七届,由习近平主席亲自谋划、亲自提出、亲自部署、亲自推动,是中国着眼推进新一轮高水平对外开放作出的一项重大决策,是中国主动向世界开放市场的重大举措。



师生还参访了虹桥国际中央法务区,了解法务区战略定位与服务体系的详细介绍,并前往段和段律师事务所虹桥分所,近距离感受知识产权服务的专业化氛围和集聚效应。郭国中主任与赵世序律师不仅讲述了中国知识产权法律服务的发展历程,还亲自引导留学生们体验雕版拓印技艺,国际学生们在亲手制作拓印作品的过程中,深刻感受中国传统文化的独特魅力与知识产权智慧的交融。

虹桥中央法务区是服务于长三角一体化发展和虹桥国际开放枢纽建设的国家战略,着力打造面向长三角、辐射全国、链接全球的法律服务“新平台”。截至目前,已汇聚一批知名度高、专业性强、在业内有影响力的律师事务所、仲裁机构、公证机构、司法鉴定等法律及泛法律服务机构入驻,搭建集公共法律服务、专业法律服务、法治研究和交流等功能于一体的综合性平台,并加速成为全国法律服务的“新地标”。



在虹桥国际中央商务区海外发展服务中心与国际人才服务中心,国际学生深入了解企业国际化服务平台在助力企业“走出去”中的核心功能与重要价值,感受这些平台为企业“出海”与企业海外维权实践提供的坚实法律保障与智力支持。


虹桥中央商务区依托虹桥综合交通枢纽,建成上海现代服务业的集聚区,上海国际贸易中心建设的新平台,面向国内外企业总部和贸易机构的汇集地,是服务长三角地区,服务长江流域,服务全国的高端商务中心。商务区已对接46个国家、130多个境外经贸合作区,同时发挥虹桥海外发展服务中心、国际人才服务中心、海外贸易中心等平台联动优势,围绕企业“走出去”诉求,以一流专业服务、一流人才支撑、一流综合配套,为企业提供全过程精准专业服务。



此次移动课堂活动极大地加深了他们对中国会展领域知识产权保护建设与成效的认知。这不仅为推动知识产权保护与国际会展的融合发展注入了新动能,更为政产学研一体化携手助力国际知识产权保护与合作奠定了坚实基础。


国际留学生活动感想:

PIMA RASHID ADAM:

Learnings from the exchange symposium with leaders of the National Exhibition and Convention Centre (CIIE) and lawyers from Duan & Duan Law Firm. Attending this symposium was beneficial as it helped to raise awareness about CIIE itself, learn about the work done by the company, and understand how it can help to improve the relationship between China and the World.

From that point, it becomes easy to know the full function of the CIIE. The discussion also paved the way to see how Intellectual Property Rights are protected during the exhibition and how China act to counter the infringement of such rights.

The debate further helps to know how China revolutionised its science and technology for its development and friendly countries. Attending the symposium changed a lot my thinking about this trade and science exhibition, which are regularly held in China.

MUGISHA EMMANUEL:

The visit to the Hongqiao International Central Legal Affairs Zone was eye-opening. Shanghai's vision to become a global legal hub is palpable in this cutting-edge zone. The seamless integration of advanced legal services, arbitration centers and tech-driven platforms is a game-changer. It's clear that Shanghai is committed to modernizing its legal frameworks and attracting international businesses.

The collaborative spirit among law firms, particularly Duan and Duan. Domestic and international professionals work together seamlessly, prioritizing efficiency and cross-border dispute resolution. This ecosystem builds trust among multinational clients, who can tap into shared expertise to navigate complex jurisdictional issues.

This zone is more than just a hub – it's a bridge between China's legal practices and global expectations. President Xi's call for innovation-driven growth resonates deeply here. Under President Xi's vision, Shanghai is poised to become a key player in China's economic and legal globalization. The Hongqiao International Central Legal Affairs Zone is a testament to this vision, fostering a dynamic ecosystem that drives growth and innovation.


MOHAMED BANGURA:

On the 6th of May 2025, during a mobile classroom program, we met with leaders from China International Import and Export (CIIE) along side a cross section of lawyers from Duan and Duan law firm. The leaders from the (CIIE) shared insights into the center's operations, future plans and its role in promoting international trade and economic cooperation. They also shared with us the impact of large scale exhibitions on both regional and international economy and industry development.

Lawyers from Duan and Duan highlighted in-depth legal analysis on issues like international business contracts, intellectual property protection in cross border exhibitions, and compliance requirements for enterprises participating in international exhibitions.

As an international student from Tongji University, this symposium was a valuable learning opportunity. we actively engaged in discussions, raised questions, and exchanged ideas. Through this activity, we were not only gained practical knowledge but also broadened our perspectives, which will be beneficial for our future academic and career development.


KHAN RAQIB HUSSAIN:

On May 6, 2025, I had the incredible opportunity to visit the Hongqiao International Central Legal Affairs Zone and a law firm, which was truly a transformative experience in understanding the intricacies of China's legal landscape. As I stepped into the modern and sophisticated Legal Affairs Zone, I was immediately captivated by the rich cultural atmosphere and the impressive collection of historical artifacts. The intricately carved wooden art pieces were particularly striking, each one telling a story of how China's legal documents have evolved over time. This seamless blend of traditional heritage and contemporary innovation was nothing short of awe-inspiring.

The presentation that followed was equally enlightening. It showcased the remarkable progress China has made in the realm of legal services, especially in the area of intellectual property (IP) protection. The emphasis on safeguarding IP during major global events like the China International Import Expo (CIIE) was particularly noteworthy. It was fascinating to see how the legal framework has been tailored to meet the unique challenges of such large-scale international gatherings.

Collaborating with the director and the team was an absolute delight. The director provided invaluable insights into how the Legal Affairs Zone attracts international businesses and effectively addresses IP protection challenges for foreign exhibitors. Their expertise and dedication were evident in every aspect of our interaction.

My visit to the Duan & Duan Law Firm was equally rewarding. The team there was incredibly knowledgeable and articulate, breaking down complex IP law challenges and solutions in a way that was both clear and engaging. Their passion for their work was palpable, and it was evident that they are at the forefront of legal innovation in this field.

Overall, this experience was not only educational but also incredibly inspiring. It has sparked a deep curiosity in me to explore further how law, culture, and global trade intersect and influence one another. I am excited to continue delving into this fascinating intersection and look forward to uncovering more about China's dynamic legal environment.


TSOLMON BALDAN-OSOR:

Attending the exchange symposium with leaders from the National Exhibition and Convention Center (CIIE) and Duan & Duan Law Firm was an eye-opening experience that deepened my understanding of intellectual property (IP) protection in international trade, particularly exhibitions. The leaders of CIIE emphasized its strategic role in fostering global trade and ensuring IP security for international exhibitors. I was particularly impressed by the proactive measures CIIE takes to safeguard trademarks, patents, and trade secrets within China’s legal framework, setting a strong example for global trade events, further balancing trade and narrowing the trade gap between other countries.

The insights from Duan & Duan Law Firm added a practical perspective, focusing on the challenges foreign companies face when navigating Chinese IP regulations. Their expertise in dispute resolution and enforcement mechanisms was highlighted through a complex real-life case study, showcasing the importance of early registration and robust legal strategies to prevent infringement.

Overall, the symposium not only enriched my understanding of China’s commitment to IP protection but also underscored the significance of international cooperation in safeguarding IP rights. It was an invaluable experience that demonstrated how strong legal frameworks can support global commerce and protect innovation.
